DailyKos has a front page diary on Open Content/Open Media that's worth a look. DailyKos is primarily a political blog but it's good to see the question of Open Content getting some interest from those traditionally more concerned with U.S. domestic politics. The article takes note of how some (Open Source Media) are jumping on the Open Content bandwagon in name only.
This use of the Open Content idea as a marketing tool (or an attempt to build a particular ethos) is something that those of truly interested in Open Content need to be aware of. I'm wondering how long it will take the Blackboard/WebCT forces of darkness to claim that they are Open Content/Source? Does anyone know of any other instances in which people are claiming to be Open Content/Source, but aren't?

Trademark violation
Open Source is trademarked by the Open Source Initiative. It's possible that they might be able to fight Open Source Media's trademark.
Meanwhile, this misappropriation of open source has been going on for a while. Not surprising. People claim things to be open source like when they don't meet the OSI definition. Then again, maybe it's just validation of open source, that is has now reached enough mainstream acceptance to be valuable through misappropriation. After all, we don't see anyone misusing Ted Nelsons' Xanadu :)
